Navigable Waters Program

 

Public Trust Lands are the submerged lands lying below the natural ordinary high water line of navigable streams and rivers within the State. Title to these lands is held in trust and is managed for the public good rather than for a specific beneficiary.

 

 

 

Dock permits on free-flowing rivers are handled by the Idaho Department of Water Resources through their Stream Channel Alteration Permits. For more information, please visit their website: http://www.idwr.idaho.gov/water/stream_dam/sca/scamain.htm.


Negotiated Rulemaking

Negotiated Rulemaking is currently under way for the Lake Protection and Submerged Land Lesing Rules.

List of Idaho Navigable Lakes and Rivers - updated June 18, 2009

The above lists of navigable lakes and rivers in Idaho are not exclusive. At some later date, the State of Idaho may determine through court action or some other means that additional lakes and rivers will be declared navigable for title purposes. Department employees are not authorized to make a determination of navigability. That authority rests with the State Board of Land Commissioners. Department employees may, however, determine the location of the ordinary high water mark along existing navigable waters.

The use of arsenic-treated, creosote-treated or Penta-treated lumber in or over the surface waters of the Priest Lake Watershed is prohibited (Priest Lake Management Plan authorized by Title 39, Chapter 64, Idaho Code).
