Rules of Practice and Procedure Before the Idaho Oil and Gas Conservation Commission

Overview

The Idaho Administrative Procedures Act was passed after 1992, and this year’s Senate Bill 1339 contained several changes to administrative proceedings for the Oil and Gas Conservation Commission. As a result, 20.07.01 no longer governs actions by the Idaho Oil and Gas Conservation Commission. IDL may bring forward a new set of rules in the future that would govern proceedings before the Idaho Oil and Gas Conservation Commission.

Repeal of these rules will reduce confusion regarding administrative and hearing processes. Negotiated rulemaking was not conducted because the rule is being proposed for repeal and it no longer has any authority.

Status of Rulemaking

The Pending Rule was approved by the Idaho Oil & Gas Conservation Commission at its September 15, 2016 meeting. Publication of the Notice of Pending Rule was published in the November 2, 2016 Administrative Bulletin, Vol. 16-11, page 28.
