Purpose of Rule

The Idaho Department of Lands administers IDAPA 20.02.01, Rules Pertaining to the Idaho Forest Practices Act on behalf of the State Board of Land Commissioners (Land Board). This rule sets forth the minimum standards for conducting forest practices on forest land to assure the continuous growing and harvesting of forest tree species and to protect and maintain the forest soil, water resources, wildlife and aquatic habitat.

This rulemaking has been initiated based on a petition received from the Idaho Farm Bureau Federation to implement Idaho Code § 38-1304(1)(f). The purpose of this rulemaking is to establish provisions related to the timely salvage of dead, dying, or threatened timber, when practicable, on non-private forest lands.

The Forest Practices Advisory Committee (FPAC), as established by Idaho Code, provides technical assistance to IDL and the Land Board in matters relating to the Idaho Forest Practices Act.

Current Status

Negotiated rulemaking has concluded. The public may submit comments when the proposed rule is published in the Idaho Administrative Bulletin in October 2026. The proposed rulemaking public comment period is tentatively scheduled for October 7 to October 28, 2026.

Proposed Rulemaking

A proposed rule is a formal, written proposal by an agency to change a rule in accordance with the Administrative Procedure Act (APA). The public is invited to submit written comments to the agency during this stage of rulemaking. A public hearing will be held for the public to submit oral comments. The agency will consider all oral comments received at the public hearing and written comments submitted during the open comment period before adopting the rule.

The public is invited to submit written comments on the proposed rule from October 7 to October 28, 2026.

IDL encourages public participation by either attending the scheduled public hearing or providing written comments to IDL during the open comment period. Two public hearings have been scheduled in October, and the public is invited to attend in person, by phone, or by Teams to provide oral comments on the Proposed Rule.

Negotiated Rulemaking
