Legislative Review of Pending Rules

The pending rules were adopted by the Idaho State Board of Land Commissioners on November 16, 2021, and were reviewed by the 2022 Idaho Legislature.

Purpose of this Rulemaking

Proposed Rulemaking Schedule

Public comment period: October 20 to November 10, 2021.

The following rule chapters are proposed to be reauthorized as previously submitted to and reviewed by the Idaho Legislature:

  • IDAPA 20.01.01, Rules of Practice and Procedure Before the State Board of Land Commissioners
  • IDAPA 20.04.01, Rules Pertaining to Forest Fire Protection

Exception: IDAPA 20.02.01, Rules Pertaining to the Idaho Forest Practices Act is on the Zero-Based Regulation review schedule for negotiated rulemaking in 2021 and is not included in this omnibus proposed rule. The IDAPA 20.02.01 proposed rule published in September 2021 under docket number 20-0201-2101.

Temporary Rules

Temporary rules effective on July 1, 2021:

  • IDAPA 20.01.01, Rules of Practice and Procedure Before the State Board of Land Commissioners
  • *IDAPA 20.02.01, Rules Pertaining to the Idaho Forest Practices Act (*Note: The proposed rule for IDAPA 20.02.01 was published under docket number 20-0201-2101.)
  • IDAPA 20.04.01, Rules Pertaining to Forest Fire Protection

These rules are necessary to protect the public health, safety, and welfare of the citizens of Idaho and confer a benefit on its citizens.

The temporary rules were adopted by the Idaho State Board of Land Commissioners on May 18, 2021, to become effective on July 1, 2021, if the existing rules are not extended pursuant to the Idaho Administrative Procedure Act.
